Refund, Cancellation & Revision Policy

Custom Creations AI ("Custom Creations AI," "CCA," "we," "us," or "our") provides custom artificial intelligence-assisted creative services to businesses and organizations.

Custom Creations AI is operated by D & W Company, a California partnership.

This Refund, Cancellation & Revision Policy ("Policy") explains CCA's general policies regarding project cancellations, refunds, revisions, and changes in project scope.

Because CCA's current business services are customized for individual Customers, specific payment, cancellation, refund, and revision arrangements may be established directly with each Customer.

1. Project-Specific Agreements Control

CCA may establish project-specific terms through a proposal, quote, invoice, statement of work, email, written communication, or other agreement with the Customer.

If project-specific terms establish a cancellation, refund, revision, or payment arrangement that differs from this Policy, the project-specific terms will control for that project.

This Policy provides CCA's default rules when different terms have not been agreed upon.

2. Cancellations Before Work Begins

Unless otherwise agreed, a Customer may request cancellation before CCA has materially begun work on a project.

If the Customer has already made payment and CCA has not materially begun work or incurred non-recoverable project expenses, CCA will generally refund amounts paid for the canceled work.

Any applicable transaction fees, third-party charges, or other non-recoverable expenses may be deducted from the refund where permitted by law.

3. Cancellations After Work Begins

Once CCA has materially begun work on a project, the Customer may still request cancellation, but a full refund is not guaranteed.

CCA may retain amounts reasonably attributable to:

  • work already completed;
  • time spent on the project;
  • AI generation or production costs already incurred;
  • third-party service charges;
  • purchased assets or licenses;
  • reserved production resources;
  • completed project stages; and
  • other non-recoverable costs associated with the project.

If the Customer has paid more than the amount reasonably owed for work and costs incurred before cancellation, CCA may refund the remaining balance.

If amounts already paid do not cover work performed or expenses incurred, the Customer remains responsible for amounts properly owed under the applicable project agreement.

4. Completed Work

Unless otherwise agreed, payments for completed and delivered custom work are non-refundable.

Because CCA's services involve customized creative work produced for a particular Customer, dissatisfaction with subjective creative preferences does not automatically entitle the Customer to a refund.

CCA will instead work with Customers through the applicable revision process when appropriate.

Nothing in this Policy eliminates any refund or remedy that cannot legally be waived.

5. Revisions

Revision arrangements for business projects are generally established directly between CCA and the Customer.

Depending on the project, CCA may agree to:

  • a particular number of revisions;
  • revisions through specified project stages;
  • reasonable revisions until an agreed level of Customer satisfaction is reached;
  • paid additional revisions; or
  • another revision arrangement.

When no specific revision arrangement has been established, CCA will determine a reasonable revision process based on the nature, price, scope, and complexity of the project.

CCA's goal is to deliver work that reasonably satisfies the agreed project requirements.

6. What Qualifies as a Revision

A revision generally means a reasonable modification to work that remains within the originally agreed project scope.

Examples may include:

  • adjusting visual details;
  • changing certain colors;
  • modifying text;
  • replacing or adjusting individual elements;
  • making reasonable changes to generated scenes;
  • correcting unintended issues;
  • refining an existing creative direction; or
  • making other reasonable modifications consistent with the original request.

Whether a requested change qualifies as a revision depends on the nature of the project and the original agreed scope.

7. Changes in Project Scope

A request may be considered new or additional work rather than a revision when it materially changes the original project.

Examples may include:

  • requesting an entirely different concept after production has begun;
  • substantially changing the creative direction;
  • requesting additional images or videos not included in the original project;
  • materially changing video duration;
  • requesting new formats or deliverables;
  • replacing the subject or purpose of the project;
  • requesting substantial work unrelated to the original deliverable; or
  • otherwise materially expanding the project's scope.

CCA may charge additional fees and adjust the delivery schedule for additional work.

CCA will generally communicate significant additional charges before performing materially out-of-scope work.

8. AI Generation and Revisions

Artificial intelligence generation involves inherent variability.

A request to regenerate or modify content may produce changes beyond the specific element the Customer asked to modify.

For example, changing one portion of an AI-generated image or video may also affect:

  • facial details;
  • backgrounds;
  • lighting;
  • positioning;
  • clothing;
  • objects;
  • movement;
  • composition; or
  • other visual characteristics.

CCA will make commercially reasonable efforts to achieve requested revisions but cannot guarantee that AI systems will reproduce every existing element identically while changing only a requested detail.

9. Errors

If CCA delivers content that materially fails to match agreed project requirements because of an error by CCA, CCA will generally attempt to correct the issue within a reasonable period.

Depending on the circumstances, an appropriate remedy may include:

  • correcting the deliverable;
  • regenerating affected content;
  • providing a replacement;
  • providing an appropriate partial refund; or
  • another mutually agreed solution.

Minor differences inherent to AI generation or subjective differences in creative preference are not necessarily errors.

10. Customer Delays

Project schedules may depend on timely Customer communication, approvals, materials, instructions, and feedback.

CCA is not responsible for delays caused by a Customer's failure to provide required information or respond within a reasonable period.

If a Customer becomes unresponsive for an extended period, CCA may pause the project.

CCA may establish a new completion schedule when the Customer resumes communication.

11. Abandoned Projects

If a Customer stops responding or fails to provide information reasonably necessary to continue a project, CCA may treat the project as inactive or abandoned after providing reasonable notice when practical.

Amounts already earned for completed work or incurred project expenses remain payable.

CCA may require outstanding amounts to be paid or a new schedule to be established before restarting an abandoned project.

12. Cancellations by CCA

CCA may cancel or discontinue a project when reasonably necessary, including when:

  • the Customer violates CCA's Terms of Service or AI Content & Acceptable Use Policy;
  • the requested content creates legal or safety concerns;
  • required payment is not made;
  • the Customer engages in fraudulent, abusive, or threatening conduct;
  • CCA's technology providers prevent completion of the project;
  • completing the project becomes technically impracticable; or
  • circumstances outside CCA's reasonable control prevent completion.

If CCA cancels a project for reasons unrelated to Customer misconduct or breach, CCA will generally refund prepaid amounts attributable to work that will not be performed.

If cancellation results from Customer misconduct, violation of CCA policies, nonpayment, or materially inaccurate information supplied by the Customer, refunds may be limited to the extent permitted by law.

13. Third-Party Costs

Some projects may require CCA to incur third-party expenses.

These may include:

  • AI generation costs;
  • specialized software costs;
  • stock or licensed assets;
  • outside production services;
  • contractors; or
  • other project-specific expenses.

When such expenses are non-refundable to CCA, they may also be non-refundable to the Customer after they have been incurred.

CCA will seek Customer authorization before incurring significant unusual third-party expenses that were not reasonably contemplated by the original project.

14. Refund Method and Timing

Approved refunds will generally be returned using the original payment method when reasonably available.

Processing times may depend on the payment provider, financial institution, or method used for the transaction.

CCA is not responsible for processing delays caused solely by financial institutions or third-party payment providers.

15. Chargebacks and Payment Disputes

Customers should contact CCA before initiating a chargeback or payment dispute so that CCA has a reasonable opportunity to investigate and resolve the issue.

Initiating a chargeback does not automatically cancel amounts legitimately owed under an applicable agreement.

CCA may provide relevant project agreements, communications, approvals, deliverables, transaction records, and other appropriate information to a payment provider or financial institution when responding to a payment dispute.

Nothing in this section prevents a Customer from exercising rights available under applicable law or payment-network rules.

16. Project Acceptance

CCA may ask Customers to review and approve work during or at the end of a project.

Customer approval of a project stage or final deliverable may limit the Customer's ability to later request changes to matters that were specifically reviewed and approved.

This does not prevent a Customer from notifying CCA of technical errors or other issues that were not reasonably apparent at the time of approval.

Requests concerning cancellations, refunds, or revisions should generally be directed to the CCA representative handling the applicable project.

18. Changes to This Policy

CCA may update this Policy as its services and business practices develop.

Updated versions will be posted on the Website with a revised effective date.

Changes will not retroactively alter project-specific cancellation, refund, or revision terms that CCA has already expressly agreed to with a Customer.
