AI Content & Acceptable Use Policy

Effective Date: August 11, 2026

Custom Creations AI ("Custom Creations AI," "CCA," "we," "us," or "our") provides artificial intelligence-assisted image, video, and creative production services.

Custom Creations AI is operated by D & W Company, a California partnership.

This AI Content & Acceptable Use Policy ("Policy") describes the types of requests and uses that CCA permits, restricts, or prohibits.

This Policy applies to requests submitted to CCA, materials provided to CCA, content created through CCA's services, and use of content delivered by CCA.

CCA's goal is to provide Customers with substantial creative freedom while maintaining reasonable legal and safety restrictions.

1. Customer Responsibility

Customers are responsible for the requests, prompts, instructions, reference materials, images, videos, audio, logos, and other materials they provide to CCA.

Customers are also responsible for how they use, publish, distribute, advertise, or otherwise exploit content delivered by CCA.

A Customer must not request or use CCA services in violation of applicable law, third-party rights, this Policy, CCA's Terms of Service, or an applicable project agreement.

CCA's acceptance or completion of a request does not constitute legal approval of the Customer's intended use.

2. Generally Permitted Content

Subject to this Policy and applicable law, CCA may create a broad range of AI-generated or AI-assisted content, including:

  • advertising and marketing content;
  • social media content;
  • product concepts and visualizations;
  • fictional characters;
  • fictional environments and scenarios;
  • humorous or parody-oriented content;
  • stylized imagery;
  • promotional videos;
  • business graphics;
  • concept art;
  • entertainment content;
  • personalized creative content;
  • content incorporating Customer-provided materials; and
  • other lawful creative content.

CCA may evaluate unusual or sensitive requests individually rather than automatically prohibiting an entire category of content.

3. Illegal Activity

Customers may not use CCA to create content intended to facilitate, promote, coordinate, or meaningfully assist serious illegal activity.

CCA may reject a request when CCA reasonably believes that completing it would violate applicable law or create a substantial risk of unlawful use.

Fictional, educational, documentary, artistic, or entertainment depictions of illegal activity are not necessarily prohibited merely because they depict illegal conduct.

Context and intended use may be considered when CCA evaluates a request.

4. Child Sexual Exploitation

CCA strictly prohibits content that sexually exploits, sexualizes, or abuses minors.

Customers may not request, provide, create, possess, or distribute through CCA:

  • child sexual abuse material;
  • sexually explicit depictions of minors;
  • sexualized AI-generated depictions of minors;
  • content designed to sexualize an identifiable minor;
  • requests to make a minor appear nude or sexually explicit; or
  • other content involving the sexual exploitation or abuse of children.

This prohibition applies regardless of whether the content is real, altered, generated, fictionalized, or presented as a joke.

CCA may report apparent child sexual exploitation material or related activity when required or permitted by applicable law.

5. Non-Consensual Intimate Content

CCA prohibits requests to create or alter sexually explicit or intimate content depicting an identifiable real person without that person's authorization where such creation or use would violate applicable law or the person's rights.

This includes requests commonly associated with non-consensual sexual deepfakes.

CCA may request evidence of authorization when appropriate.

6. Real People and Likenesses

CCA may permit content depicting or referencing real people when the requested creation and intended use are reasonably appropriate.

Examples may include:

  • a Customer using their own photograph;
  • authorized business or employee imagery;
  • fictional or humorous scenarios;
  • a person requesting an image depicting themselves with another person;
  • editorial, artistic, satirical, or entertainment-oriented depictions; and
  • other uses that CCA determines are appropriate.

However, the ability to technically generate an image or video of a person does not necessarily mean the Customer has the legal right to use it for every purpose.

Customers are responsible for obtaining any consent, publicity rights, licenses, releases, or other permissions legally required for their intended use.

CCA may require proof of authorization or refuse a request involving an identifiable person.

7. Public Figures and Celebrities

CCA does not automatically prohibit every request involving a celebrity, public figure, politician, athlete, entertainer, or other well-known person.

Such requests may be evaluated based on context, intended use, applicable law, third-party rights, and the capabilities and policies of CCA's technology providers.

CCA may refuse requests that could reasonably facilitate:

  • fraud;
  • false endorsements;
  • materially deceptive impersonation;
  • non-consensual intimate imagery;
  • unlawful exploitation of a person's likeness; or
  • other harmful or unlawful uses.

Customers should not represent AI-generated content as authentic footage, photography, speech, or endorsement of a real person when doing so would be materially deceptive or unlawful.

8. Impersonation, Fraud, and Deception

CCA prohibits use of its services to facilitate fraud, scams, identity theft, or materially deceptive impersonation.

Customers may not request content intended to falsely convince another person that:

  • a real person made a statement they did not make;
  • a person endorsed a product or service when they did not;
  • a fraudulent business or investment opportunity is legitimate;
  • fabricated evidence is authentic; or
  • another materially false event occurred,

when the content is intended to deceive others in a manner that is unlawful or likely to cause meaningful harm.

Fiction, satire, parody, entertainment, and clearly fictionalized creative work are not automatically prohibited.

9. Intellectual Property

Customers may submit requests involving brands, products, characters, artwork, logos, trademarks, copyrighted works, or other intellectual property.

CCA's acceptance of a request does not constitute a determination that the resulting content is legally authorized for the Customer's intended use.

Customers are responsible for obtaining any licenses or permissions necessary for their commercial or other use of third-party intellectual property.

CCA may reject or modify requests when intellectual property concerns create an unacceptable legal or operational risk.

10. Customer-Provided Materials

Customers may provide CCA with photographs, videos, logos, branding, artwork, audio, reference materials, or other files for use in a project.

By providing such materials, the Customer represents that the Customer has the rights or authorization reasonably necessary to provide the materials and instruct CCA to use them for the requested project.

CCA may decline to use Customer Materials when their ownership, origin, legality, or authorization is reasonably questionable.

11. Harassment, Threats, and Abuse

CCA may refuse requests primarily intended to seriously harass, threaten, intimidate, exploit, or endanger an identifiable person.

The existence of criticism, satire, parody, disagreement, fictional conflict, dark humor, or offensive material does not by itself mean that content violates this section.

CCA may consider the context, severity, target, and reasonably apparent purpose of a request.

12. Graphic and Sensitive Content

CCA may permit some fictional, artistic, cinematic, educational, documentary, or otherwise legitimate depictions of violence, injury, disturbing events, or other sensitive subjects.

CCA reserves the right to limit or reject excessively graphic content or requests that create substantial safety, legal, or provider-policy concerns.

The availability of particular types of content may also depend on restrictions imposed by the AI models and production providers available to CCA.

13. Sexual and Adult Content

CCA may establish restrictions on sexual, nude, suggestive, or adult-oriented content based on applicable law, the nature of the requested material, consent, intended use, and restrictions imposed by CCA's technology providers.

CCA does not guarantee that any particular category of adult content can be produced.

Content involving sexual exploitation of minors or unlawful non-consensual intimate imagery is prohibited under all circumstances.

CCA may reject other sexual or adult-oriented requests at its discretion.

14. Hate and Extremism

CCA may refuse requests that promote, recruit for, materially support, or meaningfully facilitate violent extremist organizations or unlawful hate-based violence.

This does not automatically prohibit historical, educational, documentary, fictional, satirical, journalistic, or critical depictions of extremist or hateful organizations, symbols, people, or events.

Context may be considered when evaluating such requests.

15. Political Content

CCA may create political, satirical, editorial, informational, or advocacy-related creative content when permitted by applicable law and available technology-provider policies.

Customers are responsible for complying with laws governing political advertising, campaign communications, disclosures, endorsements, synthetic media, and other regulated political communications.

CCA may refuse political content that materially misrepresents AI-generated media as authentic evidence or otherwise creates an unacceptable deception, legal, or safety risk.

16. Regulated and High-Risk Uses

CCA may impose additional restrictions on content intended for use in highly regulated or high-risk contexts.

These may include certain uses involving:

  • healthcare;
  • financial products or investments;
  • legal services;
  • employment decisions;
  • housing;
  • insurance;
  • credit;
  • government services; or
  • other regulated activities.

Customers remain responsible for ensuring that their advertising, claims, disclosures, and use of CCA content comply with laws applicable to their industry.

17. AI Provider Restrictions

CCA uses third-party artificial intelligence models, software, and production platforms.

Those providers may impose restrictions that are different from or more restrictive than this Policy.

As a result, CCA may be technically or contractually unable to fulfill a request even when the request is not otherwise prohibited by this Policy.

CCA may use alternative production methods or providers when reasonably available, but CCA is not obligated to circumvent a third-party provider's safety systems, restrictions, or terms.

18. CCA's Right to Review and Refuse Requests

CCA reserves the right to review project requests and Customer Materials for compliance with this Policy, CCA's Terms of Service, applicable project agreements, provider requirements, and applicable law.

CCA may:

  • accept a request;
  • request additional information;
  • request proof of permission or authorization;
  • suggest modifications;
  • partially fulfill a request;
  • refuse a request; or
  • discontinue work on a request.

CCA is not required to produce content merely because similar content has previously been produced for another Customer or because a third-party AI system is technically capable of generating it.

19. Attempts to Circumvent Restrictions

Customers may not intentionally misrepresent the purpose of a request or conceal relevant information for the purpose of causing CCA to produce content that CCA has already refused or that clearly violates this Policy.

Repeated attempts to circumvent CCA's restrictions may result in refusal of further service.

20. Enforcement

CCA may take reasonable action in response to violations or suspected violations of this Policy.

Depending on the circumstances, this may include:

  • requesting clarification;
  • modifying a project;
  • refusing particular content;
  • suspending work;
  • canceling a project;
  • declining future business; or
  • taking action required by applicable law.

Any refund or payment consequences associated with a rejected or canceled project will be determined by CCA's Terms of Service and any applicable project agreement.

21. Changes to This Policy

CCA may update this Policy as its services, technology, third-party AI providers, business practices, or legal obligations change.

Updated versions will be posted on the Website with a revised effective date.
